This was the question a group men and women in their 20s were asking on BBC1 on Tuesday night - have a look on catch up. I tuned in because despite the fact that I'm an employment lawyer and know all about definitions like "of a sexual nature" and having a "purpose or effect" of creating an intimidating or offensive environment, and facilitate discussions on this with people every week, I'm still asking the question.
The social experiment in the programme saw the men and women yo-yoing from "guilty" to "innocent" depending upon what clip of the film they saw next or indeed how persuasive the person next to them was! And that's what happens in workplaces.
We ask the participants in our workshops how they feel about certain situations. these could range from behaviour that could be interpreted as rude or thoughtless, to flirty or predatory. People demand "more context" saying they simply cannot say how they feel without context.
